It is not legal advice, safety advice, or a substitute for the judgement of a competent person. Using SWMSBuilder does not create any professional, advisory or consulting relationship.
You and the PCBU remain responsible
Under the Work Health and Safety Act 2011 and the WHS Regulations, the Person Conducting a Business or Undertaking (PCBU) and the person who prepares a SWMS are responsible for ensuring it is accurate, complete, site-specific and compliant. Every SWMS generated or drafted in SWMSBuilder must be reviewed and customised by a competent person for the specific worksite before it is used. You are responsible for the final content you publish.
AI-generated content
Where you use the optional AI draft feature, the output is a starting point produced by an automated system. It may contain errors, omissions or content that is not appropriate for your specific work. We ground generation in a curated knowledge base and cite sources with the date they were current ("as-at"), and we run automated checks — but citations and checks do not guarantee correctness, currency, or that a regulator or principal contractor will accept the document. Regulations and standards change; confirm currency for your jurisdiction and worksite.
No warranty
SWMSBuilder is provided "as is" and "as available". To the extent permitted by law, we make no warranty that the service or any output is accurate, complete, current, fit for a particular purpose, or compliant with any law, standard or contract. Nothing in this disclaimer excludes rights you have under the Australian Consumer Law that cannot lawfully be excluded.
